ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT. 

By participating in the DREAM WITH DIVI SWEEPSTAKES (the “Sweepstakes”), each participant (each, an “Entrant”) unconditionally accepts and agrees to comply with, and abide by, these Official Rules (“Official Rules”) and the decisions of Divi Official, LLC (the “Sponsor”) and US Sweepstakes & Fulfillment Company (the “Sweepstakes Administrator”), which shall be final and binding in all respects. 

SWEEPSTAKES ENTRY PERIOD: The Sweepstakes begins at 12:00:01 AM Central Time (“CT”) on Thursday, July 18, 2024 and ends at 11:59:59 PM CT on Wednesday, July 24, 2024 (the “Sweepstakes Period”). The Sponsor’s computer is the official time-keeping device for the Sweepstakes. 

ELIGIBILITY: The Sweepstakes is open to legal residents of the 50 United States, including the District of Columbia, who are age 21 or older at the time of entry. Void in Puerto Rico, Guam, the U.S. Virgin Islands, outside the U.S., and wherever else prohibited by law. Employees of Sponsor, Sweepstakes Administrator, Ulta Beauty, Inc., Target Brands, Inc., and their respective subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members (spouses, parents, children, and siblings and their spouses) of, and/or those living in the same household of each, are not eligible to enter. Sweepstakes is subject to all applicable federal, state and local laws and regulations. This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with, Ulta Beauty, Inc. or Target Brands, Inc.

HOW TO ENTER: There are two (2) ways to enter. 

Method #1: Purchase Entry: 

Step One: During the Sweepstakes Period, purchase any Divi product at a Target retail location or online at www.target.com (the “Qualifying Product”).  

Step Two: Collect your original, itemized, store-identified purchase receipt or order confirmation email dated between 7/18/24 and 7/24/24 (the “Receipt”). Keep your Receipt. Sponsor reserves the right to require a participant to provide original Receipt for verification purposes upon request. 

Step Three: Take a photo of the Receipt (the “Receipt Photo”). The Receipt Photo must clearly show the store where purchased, purchase date and the Qualifying Product purchased. 

Step Four:  Visit https://www.diviofficial.com/pages/dream, follow the instructions to complete the entry form, upload the Receipt Photo, and submit to receive one (1) entry into the Sweepstakes (the “Purchase Entry”). Before submitting a Purchase Entry, entrants can optionally share a short statement about the dream they would fund if they win the Sweepstakes (the “Statement”). The Statement is optional and will not affect entrant’s chances of winning. By submitting a Statement with a Purchase Entry, the entrant understands and grants to the Sponsor an irrevocable, perpetual, non-exclusive worldwide license to use their Statement, name, hometown and likeness on the Sponsor’s various websites and social media sites and in advertising and/or promotional activities worldwide without compensation, permission or notification. Sponsor reserves the right in its sole and absolute discretion to alter, change or modify any Statement.

Attempts to gain a Purchase Entry by submitting a Receipt that has already been submitted to the Sweepstakes will be disqualified. Only valid Receipts and Receipt Photos will be accepted and are subject to verification and will not be returned. Regardless of the number of Qualifying Products indicated on the Receipt, there is a limit of one (1) Purchase Entry per person. Purchase Entries must be received between Thursday, July 18, 2024 at 12:00:01 AM CT and Wednesday, July 24, 2024 at 11:59:59 PM CT.  

Method #2: Free, Alternate Method of Entry (“AMOE”) / Mail-in Entry: To enter without purchase, clearly hand-print your name, complete address, email address and phone number on a sheet of paper and mail that sheet of paper in an addressed envelope with proper postage to the following address to receive one (1) entry into the Sweepstakes (the “Mail-In Entry”): Dream with Divi Sweepstakes, PO Box 776, Social Circle, GA 30025-0776. Each Mail-In Entry must be mailed separately and must be postmarked between Thursday, July 18, 2024 and Wednesday, July 24, 2024 and received by Wednesday, July 31, 2024. 

Purchase Entry and Mail-In Entry collectively referred to herein as “Entry” or “Entries”. Limit: Regardless of the method of entry, there is a limit of one (1) Entry per person. Although subsequent attempts to enter may be received, only the first complete Entry received from a particular entrant will be eligible; subsequent attempts by the same person to enter, including entries submitted with an alternate email address, will be disqualified. All methods of entry have an equal chance of winning. All entries become the property of the Sponsor and will not be acknowledged or returned. Photocopied, illegible, or mechanically reproduced entries are not eligible. Sponsor is not responsible for lost, late, damaged, misdirected or postage-due mailed entries.

PRIZES/APPROXIMATE RETAIL VALUE (“ARV”)/ODDS: There are three (3) prizes (each, a “Prize”) available to be won. Each Prize winner (each, a “Winner”) will receive $10,000. Prize will be awarded in the form of a check. The ARV of each Prize is: $10,000. 

The total ARV of all prizes available to be won: $30,000. There is a limit of one (1) prize per person. Odds of winning will depend upon the total number of eligible entries received.

RANDOM DRAWING: The potential Winners will be selected in a random drawing on or about Monday, August 5, 2024 from among all eligible entries received during the Sweepstakes Period by the Sweepstakes Administrator, an independent representative of the Sponsor whose decisions are final. 

WINNER NOTIFICATION & VERIFICATION: Potential Winners will be notified by the Sweepstakes Administrator via email and/or phone, and will be required to sign and return, within three (3) days of notification, an Affidavit of Eligibility, a Liability Waiver, an IRS W-9 Form and where allowable, a Publicity Release (collectively, "the Releases"). These Releases will require the Winner to furnish their Social Security Number for the sole purpose of tax reporting, as required by law. Noncompliance will result in disqualification and an alternate winner may be selected. Prizes will be awarded within approximately 45 days after the winner is verified.

If a prize notification or Prize is returned as undeliverable, or if a Winner is found to be ineligible or not in compliance with these Official Rules, that Winner will be disqualified, and the Prize may be awarded to an alternate winner in a separate random drawing. If Sponsor is unable to determine and verify a potential winner after repeated alternate drawings or if Sponsor fails to receive a sufficient number of entries to correspond to the number of Prizes available to be awarded, Sponsor reserves the right to not award such Prize(s).

PRIZE CONDITIONS: Prizes are not assignable, transferable and may not be substituted except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value at its discretion. Any other incidental expenses on prize not specified herein are the Winner’s sole responsibility.

Winners are responsible for all federal, state, local and income taxes associated with winning prize. 

Except where prohibited by law, entry and acceptance of Prize constitute permission to use Winner's name, prize won, hometown, likeness, video recordings, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.

GENERAL: Participating entrants agree to these Official Rules and the decisions of the Sponsor and the Sweepstakes Administrator, and release the Sponsor, the Sweepstakes Administrator, Ulta Beauty, Inc., Target Brands, Inc., and their affiliated companies, and all other businesses involved in this Sweepstakes, as well as the employees, officers, directors and agents of each (the “Released Parties”), from all claims and liability relating to their participation in the Sweepstakes, and the acceptance and use/misuse of the prizes offered. Participating entrants assume all liability for and Released Parties shall be held harmless against any liability for any injury, losses or damages of any kind to persons, including personal injury or death, or injury to property caused or claimed to be caused in whole or in part,  directly or indirectly, by participation in this Sweepstakes, acceptance, possession, or use/misuse of the prize, or any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prize. 

In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may ask any entrant or potential winner to provide Sponsor with proof, to Sponsor’s satisfaction, that such party is the authorized account holder of the email address associated with the entry. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Released Parties are not responsible for: (i) lost, late, misdirected, damaged or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the Sweepstakes. By participating in the Sweepstakes, entrant (i) agrees to be bound by these Official Rules, including all eligibility requirements, and (ii) agrees to be bound by the decisions of Sponsor and the Sweepstakes Administrator, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. 

Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor. If, for any reason, the Sweepstakes cannot be run as planned, Sponsor may disqualify any suspect entries or individuals from the Sweepstakes and any sweepstakes it sponsors and (a) suspend the Sweepstakes and modify the Sweepstakes to address the impairment, then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; and/or (b) award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. 

THE RELEASED PARTIES ARE NOT RESPONSIBLE IF THIS SWEEPSTAKES CANNOT BE ADMINISTERED OR CONDUCTED OR ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS RESULTING OR ARISING FROM ACTS OF GOD, WAR, OR TERRORISM, CIVIL UNREST, STRIKES, SUPPLY SHORTAGES, NATURAL DISASTERS, WEATHER, EPIDEMICS, COMPLIANCE WITH ANY LAW OR ORDER OF A GOVERNMENTAL AUTHORITY, OR ANY OTHER SIMILAR ACT, EVENT, OR OCCURRENCE BEYOND THE REASONABLE CONTROL OF THE SPONSOR. BY PARTICIPATING IN THIS SWEEPSTAKES, PARTICIPANT AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SUCH SITE, AS APPLICABLE. 

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

GOVERNING LAW AND LIMITATION OF LIABILITY: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Sponsor or the Released Parties in connection with the Sweepstakes will be governed by and construed in accordance with the internal laws of the State of Texas, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU. 

DISPUTES: The parties hereto each agree to finally settle all disputes only through arbitration; provided, however, the Released Parties shall be entitled to seek injunctive or equitable relief in the state and federal courts in Dallas County, Texas and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Sweepstakes shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS. In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service. If an in-person hearing is required, then it will take place in Dallas County, Texas. The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in Dallas County, Texas. Sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of entrant to attend the arbitration hearing). Either party may, notwithstanding this provision, bring qualifying claims in small claims court.

PRIVACY: As a condition of entering the Sweepstakes, each Entrant gives consent for Sponsor to obtain and deliver their name, address and other information to third parties, including Sweepstakes Administrator, for the purpose of administering this Sweepstakes and to comply with applicable laws, regulations and rules, including, without limitation, the storing of your personal information for purposes of complying with state record retention requirements. Any information entrant provides to Sponsor may be used to communicate with entrant in relation to this Sweepstakes or on a Sweepstakes winner’s list. Personal information collected from entrants are subject to the Sponsor’s Privacy Policy, which can be found at https://www.diviofficial.com/pages/privacy-policy.

By participating in the Divi Official Refer and Earn Promotion (the “Promotion”), you unconditionally accept and agree to abide by these Terms & Conditions (“Promotion Terms &  Conditions”) and the decisions of Divi Official, LLC with offices located at 3403 Knight Street, Dallas, TX 75219 (the “Sponsor”), and US Sweepstakes & Fulfillment Co. with offices located at 625 Panorama Trail, Suite 2100, Rochester, NY 14625 (the “Administrator”), which are final and binding in all respects. Promotion Period:

PROMOTION IS AVAILABLE BETWEEN 12:00:01 AM EASTERN TIME (“ET”) ON JULY 1, 2024, AND 11:59:59 PM PACIFIC TIME (“PT”) ON JULY 31, 2024 (“PROMOTION PERIOD”). 

Eligibility:

Promotion is only open to Divi Official Refer-a-Friend Program members who are legal residents of the 50 United States or the District of Columbia, ages 18 and older (each, a “Qualified Members”). Promotion is void outside the 50 United States/District of Columbia and wherever else prohibited by law. Qualified Members are subject to the Divi Official Refer-A-Friend Program Terms & Conditions, which can be found at https://www.diviofficial.com/pages/promotion-terms-of-use and the Sponsor’s Privacy Policy, which can be found at https://www.diviofficial.com/pages/privacy-policy. Anyone who does not meet the set forth criteria is not eligible to participate. Employees of the Sponsor and Administrator may not participate in the Promotion. 

Overview:

During the Promotion Period, the Sponsor will track the number of qualifying sales that are directly attributed to Qualified Members who share referral codes and links as part of the Divi Official Refer-a-Friend Program, powered by Social Snowball. At the end of the Promotion Period, the two (2) Qualified Members (each, a “Winner”) who are directly attributed to the first and second highest number* of qualifying sales, will each qualify to receive a suitcase filled with Divi products of Sponsor’s choice (each, a “Prize”). The approximate retail value (“ARV”) of each Prize is $2,500. *For the avoidance of doubt, winners will be based on the highest number of qualifying sales, not the highest total value of qualifying sales. In the event of a tie, the tied Qualified Member with the highest total value of qualifying sales will be deemed the Winner. If an additional tie-breaker is needed, the Qualified Member who reached the highest total number of qualifying sales first will be deemed the Winner. 

Prize Claim:

Winners will be notified by the Administrator via email and/or phone and will be required to sign and return, within seven (7) days of notification, an Affidavit of Eligibility, a Liability Waiver, an IRS W-9 Form and where allowable, a Publicity Release (collectively, "the Releases"). These Releases will require the Winner to furnish their Social Security Number for the sole purpose of tax reporting, as required by law. Noncompliance will result in disqualification and Winner’s claim on the Prize is void. Prizes will be awarded within approximately 45 days after all Winners are verified.

If a winner is otherwise eligible under these Official Rules but is nevertheless deemed a minor in their state of primary residence, the Prize will be awarded in the name of Winner’s parent or legal guardian who will be required to execute and return the Releases on minor’s behalf, as applicable.

If a prize notification or Prize is returned as undeliverable, or if a Winner is found to be ineligible or not in compliance with these Promotion Terms & Conditions or the Divi Refer-a-Friend Terms & Conditions, that Winner will be disqualified, and the Prize may be awarded to the Qualified Member with the next highest number of qualifying sales. 

Prizes are not redeemable for cash, assignable, transferable and may not be substituted except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value at its discretion. Any other incidental expenses on prize not specified herein are the winner’s sole responsibility. Winners are responsible for all any and all federal, state, local and income taxes associated with winning Prize. 

General Conditions:

Participants are responsible for ensuring their referral methods comply with all applicable laws and regulations, including, but not limited to, requirements related to the promotion and endorsement of products and services, including those established by the Federal Trade Commission (FTC). This includes disclosing any material connection with the Sponsor or its products/services and using the appropriate hashtags or other disclosures in all promotional content. All referrals and attributed sales are subject to review and verification by the Sponsor. Sales deemed to be earned through fraudulent, illegal, or overly aggressive, questionable sales or marketing methods will be voided and result in immediate disqualification. Referrals posted on coupon sites are strictly prohibited. Participants found to be sharing or allowing their referral codes and/or links to be posted on coupon sites will be subject to immediate termination from the Promotion and the Divi Official Refer-a-Friend Program. Participation in this Promotion in violation of these Promotion Terms & Conditions may constitute fraud. In addition to disqualification and termination from the Promotion, and requiring return of the Prize or its value (as applicable), Sponsor reserves the right to pursue all available legal remedies against individuals believed to be engaged in such improper conduct. The Released Parties assume no responsibility for any computer, telephone, cable, network, electronic, programming or wireless Internet hardware or software malfunctions, failures or errors of any kind, including the failure of intended recipient to timely receive e-mail notification from the Sponsor. If circumstances beyond the control of Released Parties (i.e., a force majeure event, such as a pandemic/epidemic, strike, civil unrest, natural cataclysm, equipment failure/malfunction/error or tampering/unauthorized intervention) interfere with or prevent altogether implementation of the Promotion as originally intended (as determined by Sponsor in its sole discretion), Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Promotion. Notice of such action by Sponsor will be posted on the Sponsor’s website. By participating in the Divi Specialist Referral Promotion (the “Promotion”), you unconditionally accept and agree to abide by these Terms & Conditions (“Promotion Terms &  Conditions”) and the decisions of Divi Official, LLC with offices located at 3403 Knight Street, Dallas, TX 75219 (the “Sponsor”), and US Sweepstakes & Fulfillment Co. with offices located at 625 Panorama Trail, Suite 2100, Rochester, NY 14625 (the “Administrator”), which are final and binding in all respects. Furthermore, you agree to release the Sponsor, Administrator, Social Ladder and their respective employees, officers and directors and agents of each (collectively, the “Released Parties”), from all claims and liability relating to your participation in the Promotion. All applicable federal, state and local laws and regulations apply.

Promotion Period:

Eligibility:

Promotion is only open to Divi Specialist Program members who are legal residents of the 50 United States or the District of Columbia, ages 18 and older (each, a “Qualified Members”). Promotion is void outside the 50 United States/District of Columbia and wherever else prohibited by law. Qualified Members are subject to the Divi Specialist Program Terms & Conditions, which you agreed to upon becoming a Divi Specialist Program member (available at https://socialladder.rkiapps.com/application?areaGuid=168D12B0-277F-437A-BA8D-D68C63793469&appGuid=BA1B675C-4A4A-4DF4-86C1-9D26F401C23C). Anyone who does not meet the set forth criteria is not eligible to participate. Employees of the Sponsor and Administrator may not participate in the Promotion. 

Overview:

During the Promotion Period, the Sponsor will track all qualifying Divi Specialist Program signups that are directly attributed to Qualified Members who share referral codes and links to friends who are hair stylists. At the end of the Promotion Period, the two (2) Qualified Members (each, a “Winner”) who are directly attributed to the first and second highest number of qualifying Divi Specialist Program signups, will each qualify to receive a suitcase filled with Divi products of Sponsor’s choice (each, a “Prize”). The approximate retail value (“ARV”) of each Prize is $2,500. In the event of a tie, the Qualified Member who reached the highest number of qualifying sign-ups first will be deemed the Winner. 

Prize Claim:

Winners will be notified by the Administrator via email and/or phone and will be required to sign and return, within seven (7) days of notification, an Affidavit of Eligibility, a Liability Waiver, an IRS W-9 Form and where allowable, a Publicity Release (collectively, "the Releases"). These Releases will require the Winner to furnish their Social Security Number for the sole purpose of tax reporting, as required by law. Noncompliance will result in disqualification and Winner’s claim on the Prize is void. Prizes will be awarded within approximately 45 days after all Winners are verified. 

Except where prohibited by law, entry and acceptance of Prize constitutes permission to use Winner's name, prize won, hometown, likeness, video recordings, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.

If a winner is otherwise eligible under these Official Rules but is nevertheless deemed a minor in their state of primary residence, the Prize will be awarded in the name of Winner’s parent or legal guardian who will be required to execute and return the Releases on minor’s behalf, as applicable.

If a prize notification or Prize is returned as undeliverable, or if a Winner is found to be ineligible or not in compliance with these Promotion Terms & Conditions or the Divi Specialist Program Terms & Conditions, that Winner will be disqualified, and the Prize may be awarded to the Qualified Member with the next highest number of qualifying referral signups. 

Prizes are not redeemable for cash, assignable, transferable and may not be substituted except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value at its discretion. Any other incidental expenses on prize not specified herein are the winner’s sole responsibility. Winners are responsible for all any and all federal, state, local and income taxes associated with winning Prize. 

General Conditions:

Participants are responsible for ensuring their referral methods comply with all applicable laws and regulations. All referrals and attributed program signups are subject to review and verification by the Sponsor. Program signups deemed to be earned through fraudulent, illegal, or overly aggressive, questionable sales or marketing methods will be voided and result in immediate disqualification. Referrals must comply with all legal and ethical requirements related to the promotion and endorsement of products and services, including those established by the Federal Trade Commission (FTC). This includes disclosing any material connection with the Sponsor or its products/services and using the appropriate hashtags or other disclosures in all promotional content. Participation in this Promotion in violation of these Promotion Terms & Conditions may constitute fraud. In addition to disqualification and termination from the Promotion, and requiring return of the Prize or its value (as applicable), Sponsor reserves the right to pursue all available legal remedies against individuals believed to be engaged in such improper conduct. The Released Parties assume no responsibility for any computer, telephone, cable, network, electronic, programming or wireless Internet hardware or software malfunctions, failures or errors of any kind, including the failure of intended recipient to timely receive e-mail notification from the Administrator or Sponsor. If circumstances beyond the control of Released Parties (i.e., a force majeure event, such as a pandemic/epidemic, strike, civil unrest, natural cataclysm, equipment failure/malfunction/error or tampering/unauthorized intervention) interfere with or prevent altogether implementation of the Promotion as originally intended (as determined by Sponsor in its sole discretion), Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Promotion. Notice of such action by Sponsor will be posted on the Sponsor’s website. 2. Entry Method #2: Free, Alternate Method of Entry / Email Entry. To enter without purchase, email hello@diviofficial.com with subject line “July 2024 Influencer Promotion Entry” and include the following information: First Name, Last Name, Email Address. 

Purchase Entry and Online Entry are collectively referred to herein as “Entry” or “Entries”. Regardless of the method of entry, there is a limit of one (1) Entry per person. Although subsequent attempts to enter on a given day may be received, only the first complete Entry received from a particular entrant will be eligible; subsequent attempts by the same person to enter on a given day, including entries submitted with an alternate email address, will be disqualified. Eligibility

1. To be eligible for participation in the Divi Official Refer-a-Friend Program, applicants must be 18 years or older and have an active and valid method of payment reception.

2. Divi Official reserves the right to approve or reject any application to the program at its sole discretion.

Program Participation

1. If you sign up for the program and/or make a purchase, you will receive a unique referral code and/or link to share with potential new customers.

Commission and Payments

1. Commission rates are subject to change at Divi Official's discretion. Referrers will be notified of any changes.

2. Payments of commissions are contingent upon the collection of funds from the referred customer. Returned or canceled sales will result in the deduction of the corresponding commission from the referrer’s balance.

3. All commissions are subject to review and verification by Divi Official. This process is to ensure the integrity of the Refer-a-Friend Program and may include the delay or withholding of payment while an investigation is conducted.

4. Commissions deemed to be earned through fraudulent, illegal, or overly aggressive, questionable sales or marketing methods will be voided.

5. Divi Official reserves the right to withhold or delay payment of commissions pending an investigation of breach of these terms.

Coupon and Deal Sites

1. Posting on coupon websites, such as CouponBird and Honey, is strictly prohibited. Referrers found to be sharing or allowing their codes to be posted on such sites will be subject to immediate termination from the program and forfeiture of any pending commissions.

2. Referrers are encouraged to report any unauthorized use of their codes to Divi Official for investigation.

Intellectual Property

1. Referrers may not alter any brand assets provided by Divi Official without prior written consent.

2. All promotional materials, including but not limited to images, logos, and slogans, must be used in a manner that is respectful and consistent with Divi Official's brand guidelines.

Termination

1. Either party may terminate the referral relationship at any time with written notice.

2. Upon termination, the referrer must cease all use of Divi Official branding, promotional materials, and referral links or codes.

Limitation of Liability

Divi Official will not be liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data arising in connection with this Agreement or the Refer-a-friend Program, even if we have been advised of the possibility of such damages.

Amendment

Divi Official reserves the right to update and change these Terms and Conditions from time to time without notice. Continued participation in the program after such changes shall constitute your consent to such changes.

Agreement

By participating in the Divi Official Refer-a-Friend Program, you agree to abide by these Terms and Conditions. You understand that violation of any terms may result in the termination of your participation in the program and forfeiture of any accrued commissions.

Occasionally, Divi may offer a “promo code” or “discount code” via advertisements, promotions, etc. including but not limited to Social Media Affiliate & Influencer posts. Only code(s) provided or promoted by Divi or authorized third parties will be considered valid and honored at checkout. All offer(s) valid for a limited and specified time only as indicated directly within applicable advertisement.
